The new-look Cases and comment section has been developed with advice from experts on HCRR's editorial board. The board felt that material should be drawn from a wide variety of sources - not just legal cases - and that readers would find expert commentary to be valuable, focusing on learning points for the NHS. The section now includes complaints, claims (whether won by claimant or NHS defendant), patient stories, investigations and reviews, along with expert commentary drawn from those with expertise in the relevant field.

The cases in first section (15/1 - November 08) were:

  • The care and treatment of TW, the case of a homicide by a mental health service user, with comment on cross-boundary risk management by Dr Jeff McIlwain
  • Evans v Birmingham & the Black Country SHA, a case where a fetal blood sample proved to be a key piece of evidence, with comment from solicitor Tim Hodgetts
  • No excessive delay in diagnosis, the Medical Defence Union's account of a case where a GP successfully defended his clinical practice

In the next issue (15/2), Stuart Marchant will provide expert legal comment on the recent Birch case dealing with consent, while health and safety expert Phil Gifford will comment on three cases where people died because of incorrectly fitted bed rails.
